What changed

The original notice of 1 May 2026 set a 60-day comment period closing 29 June. On 26 June the FDA extended it, following a request arguing that the original window did not allow sufficient time to develop a meaningful response. Comments must now be submitted by 30 July 2026.

The extension is procedurally unremarkable and substantively significant. It signals the agency is prepared to take the process seriously enough to grant time, and it pushes any final determination further out.

What an extension does and does not indicate

It does not indicate the agency is reconsidering. Comment periods are extended routinely, and the underlying proposal is unchanged: FDA evaluated the nominations, found no clinical need, and proposed exclusion.

What it does indicate is that interested parties — outsourcing facilities, telehealth platforms, trade associations, clinicians, patients — considered the stakes high enough to seek more time, and that the agency agreed the request was reasonable.

Who comments, and what they argue

Outsourcing facilities and their trade association argue for clinical need, typically on grounds of dose flexibility, formulation differences and patient access. The Outsourcing Facilities Association has previously litigated the shortage delistings.

Manufacturers argue the opposite, and have supported their position with litigation alleging quality problems in compounded products.

Clinicians and professional bodies divide. Some emphasise access for patients priced out of approved products; others emphasise the absence of premarket review and the documented adverse event reports.

Patients can comment, and comparatively few do. The docket is open to anyone.

What happens after 30 July

Nothing automatic. The agency reviews submissions and issues a final determination when it does. There is no statutory deadline and FDA has published no timeline.

Compounded tirzepatide does not become unlawful on 31 July. Anyone telling a patient otherwise is either mistaken or selling something — and there is a live market in urgency around this date.

Reading the timeline realistically

Final determinations of this kind have historically taken months rather than weeks. That gives patients and providers a window, and it is a window worth using rather than waiting out.

For patients, the useful work is establishing which pathway supplies you, what your refund position is on any prepaid balance, and what an approved alternative would cost given your coverage. For providers, it is deciding whether their model survives on 503A patient-specific compounding, and saying so to their patients before the answer is forced.

The wider enforcement picture

The bulks proposal is not an isolated action. FDA issued more than 55 warning letters to online sellers of compounded GLP-1s in September 2025, over 40 to telehealth-based compounding pharmacies in late 2025, 30 more in early 2026, and a further 25 on 16 June 2026 — the last set alleging false or misleading website claims about compounded semaglutide, tirzepatide and, in one case, liraglutide.

On 6 February 2026 the agency announced it would take steps to restrict GLP-1 active pharmaceutical ingredients used in non-approved compounded products. The bulks proposal followed twelve weeks later. Read together, the sequence is a policy direction rather than a series of discrete decisions.
